Maison Neptune – Terms and Conditions
Effective Date: July 1, 2025
These Terms and Conditions (“Terms”) govern the use of all services and content provided by Maison Neptune, LLC (“Maison Neptune,” “we,” “our,” or “us”), including, but not limited to, the Maison Neptune website [www.maisonneptune.com], yacht charter services, private aviation, concierge offerings, and any related communications or transactions, whether digital, verbal, or written.
By accessing our website, submitting a charter request, entering into a booking agreement, or otherwise engaging with our services, you (“Client,” “Charterer,” or “you”) acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you are not authorized to use or access our services.
Legal Disclaimer
All information provided on the Maison Neptune website or via communication with our representatives is subject to change without notice and is not warranted for accuracy, completeness, or fitness for any particular purpose. Maison Neptune makes no guarantees or warranties, express or implied, including but not limited to merchantability, suitability, or legality of any vessel, third-party vendor, or experience.
All charters, services, and related experiences are provided “as is” and “as available.” Maison Neptune disclaims all liability for errors, omissions, or inaccuracies, and reserves the right to correct any errors or misstatements without notice.
Charter Agreements & Booking Confirmation
All yacht, jet, or concierge bookings are governed by individual Charter Agreements and/or Reservation Confirmations entered into between the Client and Maison Neptune, or its designated vendors, operators, or strategic partners. These documents define the specific terms, cancellation policies, payment schedules, and other applicable terms for each booking.
A booking is not confirmed until:
- A signed Charter Agreement or Reservation Confirmation is received and accepted by Maison Neptune, and
- The required deposit or full payment, as stated, has been successfully processed.
Maison Neptune reserves the right to refuse service, cancel a booking, or terminate an inquiry for any reason, including but not limited to breach of these Terms or suspected fraud.
Payment Terms
Unless otherwise stated in your Charter Agreement:
- A deposit of a minimum of fifty percent (50%) of the total charter price is due upon booking.
- The remaining balance must be paid no later than fourteen (14) business days prior to the scheduled departure date.
- If a charter is requested within fourteen (14) business days of departure, full payment is due at the time of booking.
Failure to remit payment as required may result in cancellation of your booking without refund, at Maison Neptune’s sole discretion.
Cancellation Policy
Cancellation terms are detailed in each Charter Agreement and are binding upon execution. In general:
- Cancellations made 120 days or more prior to the charter date may be eligible for a partial refund, less a service fee.
- Cancellations made within 120 to 10 days of the charter date are non-refundable.
- Cancellations within 10 days of departure require payment in full and are strictly non-refundable.
- Any cancellation of entertainment, catering, or third-party services within 30 days of the charter date is subject to a minimum fifty percent (50%) cancellation fee, and you remain fully liable for any non-refundable vendor fees.
All refund decisions are made at the sole and final discretion of Maison Neptune and are not guaranteed under any circumstances.
Vessel Substitution and Charter Modifications
Maison Neptune reserves the right to substitute the booked vessel or service with one of comparable or greater capacity and quality if the originally contracted vessel becomes unavailable due to mechanical failure, force majeure, or other operational circumstances.
In such events:
- Maison Neptune will make commercially reasonable efforts to reschedule your charter or offer an equivalent substitute.
- If rescheduling or substitution is not feasible, a refund may be issued at Maison Neptune’s sole discretion, which shall constitute the full extent of our liability.
Maison Neptune shall not be liable for indirect, incidental, punitive, or consequential damages, including lost profits or loss of use, arising from any change, substitution, or cancellation.
Captain’s Authority and Safety
The Captain assigned to any vessel shall have full and final authority over navigation, routing, passenger safety, and all operational matters. This includes the right to modify the route, return to port, delay departure, or terminate the charter due to weather, mechanical issues, safety concerns, or behavior deemed inappropriate or unlawful.
The Client agrees to follow all instructions of the Captain and crew. Failure to do so may result in immediate termination of the charter without refund.
Conduct, Liability & Indemnification
Clients and their guests are expected to behave in a respectful, lawful, and non-destructive manner throughout the duration of their charter. The Charterer shall be responsible for any damage caused to the vessel, equipment, or third-party property, whether accidental or intentional.
Maison Neptune shall not be held liable for injury, death, loss, or damage to persons or property arising out of or related to use of any chartered vessel, aircraft, or third-party service.
By engaging Maison Neptune, you agree to indemnify, defend, and hold harmless Maison Neptune, its owners, employees, affiliates, contractors, and partners from and against all claims, liabilities, losses, damages, and expenses, including legal fees, arising out of or in connection with your use of our services.
Third-Party Vendors and Services
Maison Neptune may engage third-party vendors or independent contractors to provide services including but not limited to catering, entertainment, transportation, staffing, and hospitality. Maison Neptune makes no warranty or guarantee as to the performance or quality of such services.
All vendor-specific issues, including dissatisfaction with food, timing, or entertainment, must be addressed directly with the provider. Maison Neptune does not provide refunds for third-party service disputes.
Intellectual Property
All content on the Maison Neptune website, including but not limited to logos, images, text, branding, and design, is the exclusive intellectual property of Maison Neptune Inc. or its licensors and is protected by copyright and trademark laws.
You may not reproduce, modify, distribute, or use any part of the website or brand materials without prior written consent.
Privacy Policy
Use of our website and services is also subject to our Privacy Policy, which governs how we collect, use, and store personal information. By using our services, you consent to the data practices described therein.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflicts of law principles.
You agree that any dispute, claim, or legal proceeding arising out of or related to these Terms, your Charter Agreement, or your use of Maison Neptune’s services shall be submitted to the exclusive jurisdiction of the state and federal courts located in St Petersburg, Florida.
Updates to Terms
Maison Neptune reserves the right to modify or update these Terms at any time without prior notice. Any changes will become effective immediately upon posting to our website. Your continued use of our services following such changes constitutes acceptance of the revised Terms.
